Any bros kena molest charge before? Pls share. Really need some advice
In deep trouble now. Small head ruled over big head n in deep shit now. Currently on bail, waiting for the follow up. Everyday is a fucking nightmare. My case is " i entered my landlady's room at 2 am n i touched her legs n stomach. I was drunk." Guess drunken state shud be proven by blood test. Idk how much it serves as a factor in e case. The lady is willing to drop charges. But the Police side doesnt seem like so. Any fellow bros with similar experience can share? Will be of great help. Thankyou bros.

Bro, why don't you consult a lawyer who will be in a better position to advice you? Cos, the answers you will get here may not be the right one. I am sure the lawyers will be negotiate something bcos now the other party doesn;t want to press charges.

Re: Any bros kena molest charge before? Pls share. Really need some advice
If you are accused of molestation in Singapore, you might find yourself compensating the victim more than S$5,000 .In compounded molestation cases, some victims are asking for sums of between S$20,000 and S$50,000
Provisions in the Singapore law allow for minor offences such as simple molestation cases, wrongful restraint or causing hurt to be settled out of court. This happens only if the victim agrees to drop the matter in place of some form of compensation. Any offer to compound the offence must also require the sanction of the judge. Negotiation for compensation happens largely without the involvement of the court. Offers of compensation are made to the victims through the case's investigation officer. |

After re-reading TS post, I think his case is not very good as the offence took place inside the victim's room. Cases which were allowed to be compounded have always had the offences being committed in PUBLIC or crowded places. I have yet to see a case (where the victim was in the safe sanctuary of her home and having the offence committed against her in there) be allowed to be compounded. |

Re: Any bros kena molest charge before? Pls share. Really need some advice
frankly... the PP has a case and I would really advice you to settle it out of court... even if you claim trial, the chances for you to win this case would be slim (with my limited understanding of your case, the only thing you can put in your defense is the credibility of your statement vs her statement)...
The Prosecution would have the burden to prove and you would have to question the evidence. Somehow, personally, I am quite skeptical on justice being served in rape and molestation cases ... |

It is not up to the accused, or the victim or even the AGC to decide settlement as and when they wish to. Accused want to settle, victim also want to settle but the AGC can say no and proceed with the charge if they buay song.

Re: Any bros kena molest charge before? Pls share. Really need some advice
TS,
For compound of cases, the most basic thing is that you are contrite and have admitted to your offence... Cannot compound if you insist that you did nothing wrong... You can broach the issue of compound with the IO and it is dependent of course on whether DPP is willing to accept compound and if the victim is agreeable to the compound of the case. And then the matter is sent to court and the judge must accept the compound else the matter is still fixed for the full court procedure. Many parties must agree to the matter, but most important is judge and victim. It could be that you may not even need to pay money if you apologise to her etc, but that is for you to negotiate with the victim and IO. You also have to understand that a compounded case does not mean that you would not be charged or have to go to court. In compound cases, you will still be charged and face court, but what happens is that the judge would be informed that the victim wishes not to pursue the matter and is willing to accept compensation for the compounding of offence. If the judge accepts the compound option, then what happens is that the judge would likely warn you for what happened and then allow the compound, recording no conviction on the charge, but going to court is still a must, unless DPP decides that a Police warning or otherwise is sufficient. |
